Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Felix Moser, operating as SnusStop ("we," "us," or "our"), governing your access to and use of the SnusStop mobile application and related services (the "Service").
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS (SEE SECTION 13).
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are under 18, you may not use the Service.
3. Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate and truthful information during registration
- Maintain the confidentiality of your login credentials
- Accept responsibility for all activity under your account
- Notify us promptly of any unauthorized use of your account
- Maintain only one account per person
4. Service Description
SnusStop is a wellness and lifestyle support application that provides:
- Nicotine pouch consumption tracking with daily logging
- Personal behavioral profile with usage insights
- Lock screen Live Activity (iOS)
- Weekly analytics, trend comparisons, and cost tracking
- Quit mode with craving management tools
- 21-day guided program with daily missions (Pro)
- Brain recovery visualization (Pro)
- Push notifications (optional)
5. Subscriptions and Billing
5.1 Plans and Pricing
SnusStop Pro is available as an auto-renewing subscription:
- Annual plan: $49.99/year
- Weekly plan: $8.99/week
Prices may vary by region and are subject to change. Current pricing is always displayed in the App before purchase.
5.2 Auto-Renewal
Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
5.3 Cancellation
You may cancel your subscription at any time through your device's subscription settings (iPhone: Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the end of the paid period.
5.4 Refunds
All subscriptions are billed through Apple In-App Purchase. Refunds are handled by Apple in accordance with Apple's refund policies. To request a refund, visit reportaproblem.apple.com or contact Apple Support. We do not process refunds directly.
5.5 Free Tier
The App can be used free of charge in tracking mode. Basic features including consumption logging, Live Activity, and weekly statistics are available without a subscription.
6. Important Health Disclaimer
SNUSSTOP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.
Please read and understand the following:
- SnusStop is a wellness and lifestyle support tool. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition, including nicotine dependence or addiction.
- The health information, recovery timelines, and scientific references in the App are based on population-level averages from published research. They are provided for educational and motivational purposes only and may not reflect your individual experience.
- SnusStop is not a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider.
- Always consult a qualified healthcare provider before making changes to your nicotine use or if you experience severe withdrawal symptoms.
- If you are experiencing a medical emergency, contact emergency services (911) immediately.
- No guarantee of results. SnusStop does not guarantee that you will reduce or stop nicotine pouch use. Success depends on many individual factors.
The App uses evidence-based motivational techniques, guided breathing exercises, and habit tracking to support your personal wellness goals. These are behavioral support tools, not therapeutic interventions.
7. Intellectual Property
All rights, title, and interest in and to the Service — including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof — are the exclusive property of Felix Moser (operating as SnusStop) and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any personal content you create within the Service (such as personal notes and mood entries). By using the Service, you grant us a limited, non-exclusive license to use, store, and process your content solely for the purpose of providing the Service. We will not share your personal content with third parties except as described in our Privacy Policy.
8. User Conduct and Restrictions
The Service may only be used for personal, non-commercial purposes. You agree not to:
- Copy, modify, distribute, sell, or lease any part of the Service
- Reverse engineer, decompile, or disassemble the software
- Attempt to gain unauthorized access to the Service or its systems
- Use the Service for any illegal or unauthorized purpose
- Impersonate any person or entity
- Share your login credentials with others
- Use automated means to access the Service (bots, scrapers, etc.)
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY RESULTS FROM THE SERVICE WILL BE ACCURATE, RELIABLE, OR COMPLETE.
WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY HEALTH INFORMATION, RECOVERY TIMELINES, OR SCIENTIFIC CONTENT PRESENTED IN THE APP.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FELIX MOSER (OPERATING AS SNUSSTOP) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
WITHOUT LIMITING THE FOREGOING, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED US DOLLARS ($100).
YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT WE SHALL NOT BE LIABLE FOR ANY HEALTH OUTCOMES, WITHDRAWAL SYMPTOMS, CESSATION RESULTS, OR OTHER HEALTH-RELATED CONSEQUENCES ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE OR ANY CONTENT THEREIN.
THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY ARISING FROM OUR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, FRAUD, OR PERSONAL INJURY.
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify, defend, and hold harmless Felix Moser (operating as SnusStop) from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) your misuse of the Service; or (c) your violation of any rights of a third party.
12. Assumption of Risk
You acknowledge that nicotine cessation or reduction involves health-related risks and potential withdrawal symptoms. You voluntarily assume all risks associated with your use of the Service, including any reliance on health information, recovery timelines, or scientific content presented in the App.
You agree to consult a qualified healthcare provider before making any health decisions based on information in the App.
13. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
13.1 Informal Resolution First
Before initiating any formal dispute resolution, you agree to first contact us at legal@snusstop.at with a written description of your claim and give us 30 days to attempt to resolve it informally. Most disputes can be resolved this way.
13.2 Binding Individual Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
The arbitration will be conducted in English. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.
We will pay all arbitration filing fees, administration fees, and arbitrator fees beyond the initial consumer filing fee (currently $200 under AAA rules). If the arbitrator finds that your claim was brought in good faith, we will reimburse the filing fee as well.
13.3 Class Action and Jury Trial Waiver
YOU AND SNUSSTOP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
YOU WAIVE ANY RIGHT TO A JURY TRIAL.
13.4 Small Claims Court Exception
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of that court.
13.5 Mass Arbitration Procedures
If 25 or more similar arbitration demands are filed against us within a 90-day period ("Mass Filing"), the following procedures apply: (a) demands will be organized into batches of no more than 10; (b) one batch will proceed to arbitration first as a "bellwether"; (c) the results of the bellwether batch will inform resolution of the remaining demands; (d) remaining demands will be held in abeyance until the bellwether process is complete.
13.6 Opt-Out Right
You have the right to opt out of this arbitration agreement by sending written notice to legal@snusstop.at within 30 days of first accepting these Terms. Your notice must include your name, email address associated with your account, and a clear statement that you wish to opt out of the arbitration provision. If you opt out, you may pursue claims in court.
13.7 Severability of Arbitration Provision
If the class action waiver in Section 13.3 is found to be unenforceable, then the entirety of this arbitration provision (Section 13) shall be null and void, and disputes shall be resolved in court. All other provisions of these Terms shall remain in effect.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
For any disputes not subject to arbitration, you agree to submit to the personal jurisdiction of the state and federal courts located in the State of California.
If you are a consumer in the European Union, nothing in these Terms affects your rights under mandatory EU consumer protection law, including the right to bring proceedings in the courts of your country of residence.
15. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in illegal activity, or abuse the Service. We will provide notice where practicable.
You may terminate your account at any time by deleting it in the App settings (Settings → Delete Account). Upon termination, your data will be deleted in accordance with our Privacy Policy.
Important: Deleting your account does not automatically cancel an active subscription. You must cancel your subscription separately through your device's subscription settings before deleting your account.
16. Account Deletion
You may delete your account directly within the App (Settings → Delete Account). Upon deletion:
- All your personal data will be deleted from our active databases within 30 days
- Your data will be removed from our service providers' systems
- Anonymized, aggregated data that can no longer identify you may be retained
- Data required by law (e.g., financial records) may be retained for the legally required period
17. Service Availability and Force Majeure
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Neither party shall be liable for any failure or delay in performing obligations due to causes beyond reasonable control, including natural disasters, acts of government, internet or telecommunications failures, power outages, cyberattacks, pandemics, or failures of third-party service providers (including Apple, hosting providers, and payment processors).
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes.
18. Apple-Specific Terms
If you access the Service through an Apple device, the following additional terms apply (as required by Apple):
- Acknowledgement: These Terms are between you and Felix Moser (operating as SnusStop), not Apple. We are solely responsible for the App and its content.
- Scope of license: You are granted a non-transferable license to use the App on any Apple device that you own or control, subject to Apple's Usage Rules in the App Store Terms of Service.
- Maintenance and support: We are solely responsible for maintenance and support of the App. Apple has no obligation to provide maintenance or support.
- Warranty: We are responsible for any product warranties, whether express or implied. Apple has no warranty obligation. Apple may offer a refund of the purchase price for non-conforming Apps but has no other warranty obligation.
- Product claims: We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, regulatory compliance claims, or consumer protection claims.
- Intellectual property: We, not Apple, are responsible for any intellectual property infringement claims.
- Legal compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government restricted parties list.
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
- Developer contact: For questions or complaints about the App, contact us at support@snusstop.at. See Section 20 for full contact information.
19. General Provisions
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.
No Waiver
Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or our right to enforce it in the future.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, with notice to you.
20. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date above. For material changes (especially to the arbitration provision), we will provide notice via email or in-app notification at least 30 days before the changes take effect.
Material changes to the arbitration provision will not apply retroactively to disputes that arose before the change. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
